人口管理制度的法治思维与法治方式的创新

摘　　要：在依法治国的背景下,人口管理必须遵循法治精神,运用法治思维,创新管理理念。为此,必须树立"公民合法权益平等维护现实实现"的新理念,开拓由以户管人转向以身份证管人的新思路,拓宽法律规范、市场选择、利益调整多元化人口管理新思维;进一步完善人口管理的宪法规范,并制定《人口登记管理法》,建立健全与人口管理相关的法律制度,健全人口信息管理制度。Under the background of the rule of law in China,population management should be carried out according to the law by adopting the legal thinking and innovative management ideas. As a result,it is necessary to create the new ideology of ＂ safeguarding practical realization of citizen＇ s lawful rights and benefits through equal protection＂,to change the household- oriented population management into the ID- oriented population management,and to promote the population management through a multiple way of legal norm,market choice and reconfiguration of interests. It is necessary to perfect constitutional regulations on population management,to enact Population Registration and Management Law,and to enhance the other relevant rules and legislations on population management and population information managing system.
