摘　　要：土地承包经营权能变化是研究我国农村土地制度的重要方面。通过对土地承包经营权能扩展研究发现,其具有集体所有权逐步收窄、农户承包经营权逐步丰富、纯收益权能逐步形成的特征,土地承包经营权权能保护由债权向物权转变。在农村土地承包经营权能进一步发展过程中,面临着土地承包经营权获取、行使和流转的市场管理缺陷等问题。为此,需要进一步明确土地承包经营权获得办法,制定土地承包经营权行使规定,创新土地承包权流转管理手段,完善农户土地承包经营权保障制度,防控权能扩张带来风险。Changes on property Rights of Rural Land Contract Operation is important for land system in china＇s rural area.Restricting collective ownership and increasing the household＇s use rights is the trend of expanding of Rural Land Contract Operation property Rights, when Agricultural tax was canceled, then Agricultural subsidies have been provided, it is an right of benefit to household pure,the law protection is from obligatory right to real right, but facing difficulties in qualification of access right, rules of operating rights and management of transferring. Finally on the basis of these researches, put forward some following suggestion ： Clear methods in right to the contracted management of land access, innovate management on the land contracting right, invoke management on the provisions of the right to transfer land contract, improve the security system of farmers the right to land contractual management, prevent and control of power expansion risk.
