新实质解释视域下的破坏生产经营罪之构成要件--以“恶意好评”行为入罪为视角

摘　　要："恶意好评"行为引发人们对刑法形式解释和实质解释之再探讨。形式解释和实质解释在解释破坏生产经营罪构成要件时陷入了难以突围的困境,通过剖析形式解释和实质解释解释破坏生产经营罪构成要件困境产生之根源,并澄清新实质解释的内涵以及经其对破坏生产经营罪构成要件进行解释后,"恶意好评"行为被合理入罪。The emergence of＂malicious praise＂triggers off people＇s re-exploration of the formal and substantial explanation of criminal laws,which seem to fall into a dilemma when trying to explain the constitutive requirements of the Crime of Sabotaging Production and Business Operation. This paper tries to explore the roots of this dilemma and clarify the connotation of new substantial explanation. After explaining the constitutive requirements of the crime, the behavior of＂malicious praise＂is justifiably listed as a crime.
