论《TRIPS协定》例外条款解释的扩张化趋势

摘　　要：部分WTO成员在与《TRIPS协定》例外条款有关的WTO争端案件中,提出应当直接以《TRIPS协定》目标和原则作为例外条款解释依据的观点;要求TRIPS理事会解释《TRIPS协定》第30条并且阐述了以公共健康保护为理由直接实施例外条款的意愿,表现出对例外条款解释扩张化的趋向。知识产权对于经济发展的积极作用等原因促使各国希望最大限度地利用例外条款。《TRIPS协定》目标多元化、例外条款内容的限定性和语言的模糊性,又为WTO成员的例外条款解释扩张化提供了自由空间。Part of the WTO members, in the WTO dispute cases with the relevant exception clauses of the TRIPS Agreement, stated the view that such as the objectives and principles of the TRIPS Agreement should be used directly to explain the exception clauses, asked for the TRIPS Council to explain Article 30, and wanted to implement the exception clauses of the TRIPS Agreement directly in order to protect public health, showing the tendency of the extensive interpretation of the exception clauses in the process. Such as the positive role of intellectual property rights to promote economic development motivate, every country hopes to make the most of the exceptions clauses. The polybasic objectives of the TRIPS Agreement, the definiteness of the contents of the exception clause and the ambiguity of the language provide some free space to for WTO members to expand the interpretation of the exception clauses.
