摘　　要：我国的林业资源灾害主要有两大类,即森林火灾和森林病虫害灾害。目前,我国有关森林防火和森林病虫害防治方面的法律规定主要是针对保护国有森林资源制定的,并且基本都是集体林权改革以前的法规。随着林权改革的深入,出现了私有林木资源如何保护的问题。从分析目前我国非公有制林业资源保护存在的法律问题出发,提出具体解决对策,以期更好地保护我国的非公有制林业资源。Forest resources disasters of China are mainly divided into such two categories as forest fi res and forest pest disasters. At present, the laws about the forest fi re and forest pest control aspect mainly aim at the protection of stateowned forest resources development, and most of them are formulated before the reform of collective forest rights. With the deepening of Forest Tenure Reform, there appeared many problems of how to protect private forest resources. This paper tries to analysis the legal problems of non-public forestry resources protection in China at fi rst, and puts forward specifi c solutions, in order to protect the resources of non-public forestry in China better.
