摘　　要：中国旅游消费者的求偿权行使状况并不乐观,很多中国旅游消费者因为小额纠纷的求偿法律程序繁琐、自身对于合法求偿权的认知不足,所以最终放弃行使求偿权。因此,应该根据中国旅游消费者的实际状况,加强法律政策宣导,以及促进旅游纠纷行为程序审理的简易化,鼓励中国旅游消费者依法行使求偿权。The exercise situation of claims of Chinese tourist consumers is not optimistic, and many tourists eventually abandon their claims＇ right due to the tedious proceedings of small claims disputes, or their own lack of awareness of the legal claims. Therefore, it should be based on the actual situation of Chinese tourism consumers, strengthening the legal and policy advocacy, and the promotion of tourism behavior dispute trial simplifi ed procedures to encourage Chinese consumers to exercise claims tourism law.
