摘 要:试图借鉴可罚的违法理论来解读"但书",不仅不会光大"但书"出罪功能,而是限制了"但书"出罪功能;试图运用可罚的违法理论为行政违法与刑事不法的区分提供标准的进路,对我国刑法理论而言也不是前沿性的创举,因为应受惩罚性历来在我国犯罪概念中占据重要的位置;鉴于我国刑法明文规定了对犯罪的"量"的要求,我们也不需要援引可罚的违法理论就可以实现轻微违法行为的非犯罪化,援引条文出罪显然要比引进"理论"出罪更具权威性。Trying to refer to punishable illegality theory to interpret proviso will restrain the qcquiting function of the proviso instead of expanding it. Using punishable illegality theory to provide criteria for distinguishing administralive illegality from eriminal illegality is an innovative action tor China's criminal theories because being subject to criminal punishment has always occupied an important position in the concept of crimes in China. In view of the faet that the Chinese Criminal Law clearly prescribes " quantity" requirements of the crimes we can say that there is no need to refer to the punishable illegality theory tot the realization of non -criminalization for ight illegal behaviors.
