摘　　要：建筑工程设计合同与其他建设工程合同一样，属承揽合同的一种，但其又与建设工程施工合同存在差异，具有一定的特殊性。本文尝试结合建筑工程设计合同的特点及其履行中的程序要求，对建筑工程设计合同纠纷中常见的合同效力争议、设计费争议以及设计文件质量争议等问题的处理，提出一些看法和意见，以期对司法和工程实践有所裨益。Architectural design contracts, as wett as atly other construction projects contracts, are defined as a type of contracts for work. However, certain particularities in architectural design contracts make them different from other construction projects contracts. In this paper, we try to put forward some views and opinions on disputes over validity of architectural design contracts, design fee and design documents quality by combining the characteristics of architectural design contracts and the procedural requirements when performed. We hope these opinions can benefit the juridical practice and engineering practice
