美国行政法官制度探析

摘　　要：在美国,负责行政裁决的行政官员被称为行政法官,包括行政法法官及非行政法法官。行政法官与司法法官不同,行使的是行政司法权。行政法官独立地进行行政裁决,并有相关制度保障其独立地位。研究美国行政法官制度,对健全我国行政听证制度、完善行政复议制度,具有重要的借鉴意义。In the United States,the executive officer in charge of administrative adjudication is referred to as the administrative judge,including the administrative law judges and the non-administrative law judges. The administrative judges and judicial judges are different,the former independently carry on the administrative adjudication,and there are relevant systems to protect their independent status. The research of American administrative judges system has important reference value to improve Chinese administrative hearing system and administrative reconsideration system.
