摘　　要：研究了我国战略性新兴产业知识产权司法保护、技术创新绩效对产业升级的影响。结果显示,知识产权司法保护显著地促进了我国战略性新兴产业升级,知识产权司法保护与产品创新绩效的交叉项对我国战略性新兴产业升级的影响较为显著,知识产权司法保护与流程创新绩效的交叉项对战略性新兴产业升级的影响并不显著。知识产权司法保护与技术创新绩效对战略新兴产业升级的影响在不同行业均呈现较为明显的异质性。这些结论对于全面提升我国知识产权综合能力,实现创新驱动发展具有重要启示作用。The paper studies the effects of intellectual property rights judicial protection and technological innovation performance to industrial upgrading of strategic emerging industry in China.The results show that the intellectual property judicial protection significantly promotes industrial upgrading of strategic emerging industry in China,and the cross term between intellectual property rights judicial protection and product innovation performance has a significant influence on industrial upgrading,but as to the cross term between process innovation performance and intellectual property rights judicial protection,there is no significant impact on strategic emerging industries upgrade.Intellectual property judicial protection and technology innovation performance have different influences on industries upgrade in different industries.These conclusions are helpful to improve comprehensive ability of intellectual property rights and realize innovation drive development in China.
