从对外关系权能“一致性”分析欧盟外交事务与安全政策高级代表的法律定位

摘　　要：欧盟对外关系权能由经济领域拓展到政治领域,呈现"一致性"的趋向,《里斯本条约》承继了《欧洲宪法条约》在对外关系权能方面最核心的机构改革,设置了欧盟外交事务与安全政策高级代表一职。高级代表的法律定位不仅与原来欧盟共同外交与安全政策高级代表有较大的改革,而且与主权国家和其他国际组织的对外交往部门也不同,反映了欧盟发展过程中的超国家主义了和政府间主义的纠葛。高级代表的设置提升了欧盟对外交往的能力,提高了欧盟的影响力,推进了国际法治的实现,推动了国际组织法的发展。External relations power of EU extends from economic field to political field,presenting the trend of consistency.Lisbon treaty inherits the institutional reform in the European Constitutional Treaty at the aspect of external relations power,setting forth the position of the European Union High Representative for foreign affairs and security policy.The legal status of High Representative is not only different from the legal status of European Union common foreign and security policy high representative,but also different from the foreign affairs department in the sovereign nations and other international organizations,reflecting the controversy between supranationalism and intergovernmental in the process of EU′s development.The position of High Representative enhances the foreign affairs ability of EU and the influence of EU,promoting the realization of the international rule of law and the development of international organization law.
