引诱他人向自己卖淫行为的定性分析

摘　　要：引诱他人向自己卖淫的行为究竟是否属于引诱卖淫罪的实行行为,在学界和实务界都存在分歧。从形式上看,引诱他人向自己卖淫既是引诱卖淫罪规制的一种行为,也是一种嫖娼行为。依据目的解释、比较解释、体系解释,对于引诱卖淫罪应该进行限缩解释,引诱他人向自己卖淫不属于引诱卖淫罪的实行行为,其实质上属于嫖娼的一种行为。Academic circles and practical field have a debate whether the behavior of seducing others to engage in prostitution to oneself is a kind behavior of crime of inducing prostitution. In form,the behavior of seducing others to engage in prostitution to oneself belongs to the behavior of crime of inducing prostitution and the behavior of going whoring. Based on the objective explanation,comparative interpretation,system interpretation,we should do the limited explanation on the crime of inducing prostitution. The behavior of seducing others to engage in prostitution to oneself does not belong to the behavior of crime of inducing prostitution. In essence,it belongs to going whoring.
