工程建设领域中介机构腐败行为分析及其治理

摘　　要：工程建设领域历来是腐败的"重灾区"。其中,许多腐败行为是由中介机构参与实施的,这严重损害了市场竞争秩序,也易引发工程质量、安全事故。工程项目建设专业性强,涉及到的中介机构众多,而不同中介机构的腐败路径各不相同,治理对策也应有所差异,有必要对其进行分类研究。在当前国家全面清理、规范中介服务的社会大背景下,梳理了工程建设领域的中介服务,厘清了工程项目建设中的建设环节、中介业务、中介机构之间的映射关系,并从市场化程度和行政化程度这两个维度对工程中介机构进行了分类;着重基于权力来源不同的视角归纳总结了准行政类和其它类工程中介机构常见的腐败行为,剖析了这两类工程中介机构腐败行为的共同特征和各自特征;针对这些特征,提出了工程中介机构腐败行为的治理对策,以供政府相关部门决策参考。Corruption is the most common phenomenon in the field of engineering construction. Many corrupt behaviors are implemented by the intermediary agencies,which not only cause damage to the market competition order but also easily lead to the occurrence of safety hazards and engineering quality accidents. Because of its professional nature,engineering project construction involves many intermediary services,and because of different intermediary agencies implement corrupt behaviors differently,governance countermeasures should also be different,it is necessary to conduct classified research. In the current social background that the nation is cleaning intermediary services comprehensively,this paper firstly sorted out the intermediary agencies in the engineering construction field,clarified the links among construction segments,intermediary business,intermediary agencies,and classified the intermediary agencies according to the degree of marketization and administration;secondly,summarized the common corrupt behaviors of quasi-administrative engineering agencies and other engineering agencies,analyzed the common features and respective characteristic of corrupt behaviors of the above engineering agencies; finally, in view of characteristics,proposed countermeasures to govern corrupt behaviors of engineering intermediary agencies for the relevant government departments.
