论中国煤炭期货市场法律监管的现状及其完善路径

摘　　要：作为现代市场经济发育成熟的产物,煤炭期货市场已经成为经济学界和法学界所聚焦的热点。煤炭期货市场具有高风险性,必须采取法律手段对其进行监管和监督。就我国现有的煤炭期货市场法律监管体系而言,存在着诸多问题,这些问题集中体现在缺乏投资者相关保护制度、法律监管机构定位模糊、自律监管的缺失和虚化等多个层面之上。必须以完善法律制度设计,尽快制定《期货法》,修改并完善既有的法律规定等方法及手段,促进煤炭期货市场健康运行。As a mature product of modern market economy, coal futures market has become a hot topic in both economics field and legal field. The coal futures market is of great risk; therefore, legal means should be adopted to supervise it. As of the current supervision system, there are many problems; such as, lack of protection of the investor, lack of clear supervision mechanism and lack of self-supervision. Thus we must improve our legal system and make futures law to ensure the smooth operation of coal futures market. By making law, we will establish and improve the investor protection system. By making law, we will make clear the orientation of supervision institutions.
