摘　　要："亲亲相隐"制度是我国从汉代到民国时期刑法史中重要的法律制度,它在我国的历史过程中经历了两千多年的司法实践,为办案取证发挥了积极的作用,现当代司法实践诉讼"取证难",与废除"亲亲相隐"制度有着重要的联系。本文研究国内国外"亲亲相隐"制度存在的合理性,并以人性为出发点的相隐制度对社会发展和社会关系的和谐建立,加以合法合理利用具有一定的理论意义和实践意义,谨供司法实践取证弘扬其长处。＂ Kin concealment＂ system is an important criminal law legal system in the history of China from the Han Dynasty. It has undergone over two thousand years of judicial practice in the course of history in our country,as investigators forensics play an active role. It has important links between contemporary judicial practice litigation ＂ hard evidence＂ and the abolition of ＂Kin Concealment＂ system. In this paper,the author discuss the rationality of the existence of＂kin concealment＂ system home and abroad. And it has certain theoretical and practical significance on legitimate and reasonable use of and to humanity as a starting point with the implicit system of the concealment system,which can promote the strengths judicial practice.
