摘 要:社会保险行政部门的工伤认定是受工伤职工能够获得工伤保险待遇补偿的前提,直接关系到职工的合法权益。而工伤认定行为是典型的依申请行政行为,申请人在申请时限内提出申请,行政机关才能受理。申请时限是申请时效制度的内容之一,它与申请行为、法律后果共同构成了时效制度。我国法律规定的工伤认定申请时效制度仍然存在问题,比如时限的起算点问题、耽误制度不完善等,在实践中也引发了诸多争议,法律规定仍然需要进一步完善。The identification of work-related injury of the social insurance administrative department is the premise that the work-related injury workers can get work-related injury insurance compensation. So it is directly related to the legal rights and interests of workers. The identification of work-related injury is a typical administrative action according to application. Only when the applicant applies within the time limitation can the administrative organs accept it. Application limitation is one of factors of the application prescription system which has three basic factors: application actions, limitation and legal consequence. The application prescription system of identification of work-related injury in our country is still not perfect, such as, the problem of starting point of application, delay system etc. These imperfections have caused many disputes in practice, so the law still needs further perfecting.
