中法两国法律法规引导出版价值比较研究

摘　　要：市场经济条件下的出版发展和繁荣离不开法律法规的规范和引导,这既是出版的属性和功能决定的,也是法的本质和特征决定的。法国法律法规引导出版价值在价值取向、立法层次、法律执行、守法环境四个方面与中国存在区别,且值得中国借鉴。中国可通过"加宽追惩范围,提高出版自律程度;加快专门立法,健全法律引导体系;加深监管力度,厘清执法协作网络;加强教育培训,创设良好守法环境",来实现出版法律法规对出版价值的有效引导,进而促进中国出版的健康发展和繁荣。The specification and guidance of laws and regulations is indispensable to the development and prosperity of publication under the condition of market economy, which is determined not only by the attributes and functions of publication but also by the essence and the character of laws. The France＇s guidance of laws and regulations for publication value is different from China＇s in values, legislative levels, law enforcement and law abiding environment. What＇s more, the west＇s experience is worth for China to learn. China can achieve effective guidance of laws and regulations for publication value and promote the healthy development and prosperity of Chinese publishing through four channels： broadening the range of punishment and improving the self-regulated degree of publication, quickening special legislation and perfecting the law guidance system, deepening the supervision efforts and clarifying the enforcement collaboration network and strengthening education training and creating good law abiding environment.
