论登记离婚自由及其限制——以设立别居制度为视角

摘　　要：保障离婚自由,反对轻率离婚是我国的婚姻法的一项基本原则。但我国登记离婚制度设计却显得自由有余,限制不足,忽视个人对社会的责任,导致自由与正义价值失衡,轻率离婚现象严重。有必要在登记离婚中引入别居制度,对登记离婚自由进行适当限制,以增加婚姻的稳定性,促进社会和谐与稳定。It is one of the basic principle of the Marriage Law to protect freedom of divorce,while opposite to wanton divorce.It is too liberal and is lack of constraints to the freedom of register divorce.It ignores one＇s responsibility to the society,caused the imbalance between freedom and justice,and leads to wanton divorce.It is necessary to appropriately limite freedom of divorce by setting the separation system in the register divorce to increase the stability of marriage and promote social harmony and stability.
