论党内法规与国家法律的冲突与协调

摘　　要：随着依法治国,建设社会主义法治国家进程的逐步推进,"依法治党"、"从严治党"成为法治中国背景下,建设"打铁还需自身硬"的政党新要求。实现依法治党,既要遵循党内法规,又要严格的遵守宪法和法律。但是,在党内法规与国家法律的制定与实施过程中,却出现了党内法规与国家法律规定不明、难以衔接、党员权利保障实施困难以及"动态错位"等问题。法治思想尚未形成、党内法规与国家法律体系之间缺乏互动沟通、党内法规可操作性不强以及党内法规的清理备案工作尚未取得实效等是两者产生冲突的主要原因。提出了从理念、立法主体、内容、体系四个方面实现党内法规与国家法律协调的路径。With the development of law-based governance and the construction of a socialist country under the rule of law, ＂party in accordance with the law＂ and ＂strictly governing party＂ has become the new requirement for building the great CCP under the background of law-based China. The implementation of governing CCP in accordance with the law should not only follow the inner-party laws and regulations, but also strictly abide by the constitution and laws. But in the process of the formulation and implementation of the party regulations and state laws, the following problems appears： the unclear inner-party laws and regulations and legal provisions of the state, the difficult connection, the difficult implementation of CCP member right guarantee, the dynamic ＂dislocation＂, and so on. The following are the main reasons for the conflict： the law-based governance thought has not yet formed,and the inner-party laws and regulations and national legal system lack interaction and communication, and the operability of CCP regulations is weak, the effectiveness in cleaning up and filing of inner-party laws and regulations has not been reached, and so on.This paper puts forward the path to realize the coordination of inner-party laws and regulations state laws from the following four aspects： philosophy, the legislative subject, content, and system.
