承包商低于成本价投标报价的原因和对策研究

摘　　要：分析低于成本价中标现象屡禁不止的原因,认为杜绝低于成本价中标既不可能、也没必要。实践中应通过适当的制度安排来实现维护市场秩序、保证工程质量的立法本意。研究结果对低于成本投标报价提出建议,以达到既能保证充分市场竞争,又不危及市场秩序与当事人利益的目的。Through analyzing the reasons why bidding price lower than the project cost can＇t be eliminated in practice, this paper considers that it is neither possible nor necessary to forbid the bidder whose price is under the cost to win. The legislative intent of keeping the order of market and guaranteeing the quality of projects can be realized by appropriate institutional arrangements. Then, puts forward the system arrangements to achieve full market competition without compromising the market order and the interests of the parties.
