摘　　要："十三五"时期,全面整合"碎片化"社会保障体系启程,这将推动长期滞后的社会保障法律建制从初级阶段进入发展阶段。剖析初级阶段社会保障法律建制"分割"与"整合"扭结矛盾之困局,凸显相关经济社会政治体制的基础性、战略性问题尚未解决,这是我国经济社会发展的阶段性使然。发展阶段的社会保障法律建制,要立足于全面改革的战略高度,遵循社会保障体系规律,以科学理念为统领,以体制改革为突破口,以基础制度整合带动全面整合,构建整合型社会保障法律体系。＂Thirteenth Five Year Plan ＂ period,fully integrated social security system of＂fragmentation＂has set out,which will promote the long-term lagging social security legal system from the primary stage into the development stage. By analyzing kink contradiction between ＂division＂and ＂integration＂of social security legal system during the primary stage,highlight that the foundational and strategic issues related to economic,social and political system hasn＇t been solved yet,which is the result of economic and social development stage in our country. Social security legal system of development stage should build integrated social security legal system as follows,basing on the strategic height of comprehensive reform,following the rules of social security system,regarding scientific concept as the commander,taking system reform as the breach,making basic institution integration to drive full system integration.
