摘  要:农村宅基地使用权隐性流转普遍存在,一户多宅、隐性占用、违法出售和触及法律的联合建房等隐性流转行为仍在继续发生。这些隐性流转行为为什么不能彻底禁止?其根本原因在于宅基地产权制度模糊和监管失灵、宅基地法律产权和事实产权不一致以及宅基地现实价值和潜在价值的提升。显然,完善法律规制、严格监管和完善利益调节机制是规制宅基地隐性流转的可行途径。It's very common that rural housing land use right circulates implicitly, a household multi-occupied housing land,implicit occupied housing land, the unlawful sale and touch on the joint construction of the law continued to occur. Why can't atotally ban the circulation of these implicit? Its root cause lies in the homestead's fuzzy and regulatory failure, the homestead lawof property right system of property rights and the fact property rights is inconsistent, as well as promotion of homestead real val-ue and potential value. It is clear that perfect legal regulations, strict supervision and perfect the adjustment mechanism of inter-est is recessive flow regulation homestead a feasible approach.
