摘　　要：日益发展的时代催生了新兴的产业。电信产业的出现为我们的生活带来了无尽的便捷、多彩的生活，与此同时围绕着电信服务合同也产生了无穷的纠纷。在理论上关于电信服务合同的定义、性质、特征都有不同的看法，加之我国关于电信服务业的法律法规不够健全，因此出现了诸如垃圾短信、滥用格式条款等问题。只有在全面把握电信服务合同的基础上方能找到解决电信服务合同法律关系中所存在问题的办法，从而更好地保护利益相关人的合法权益。The developing era creates a new industry. The emergence of telecommunications industry brought endless convenience and color to our life. At the same time, endless disputes around the telecommunication service contract has arisen. Theoretically, there are different views on contract definition, nature, and characteristics about telecommunication service. Further more, China lack of sound laws and regulations on the telecom service industry. Therefore, there are such problems as spam and abuse of terms of format etc. Only through comprehensive grasp of telecom service contract can we find a way to solve the existing problems of the legal terms in telecommunication service contract. In this way, the legitimate rights and interests of the stakeholders could be better protected.
