数据库里的囚徒:论网络空间里的主体变体与隐私保护

摘　　要：网络文化的传播媒介是数字,数字在网络空间中表现为数据库。数据库在网络空间里隐秘地生产着数量庞大的主体变体。数据库的民主化、商业化和政治化使数据库里的主体变体由私人空间流向公共空间。主体变体的公共化为侵犯个人隐私埋下了祸根。大众的焦虑否定了网络隐私的敞开化,个人隐私在大数据时代必然受到重视并被学者关注和研究。网络空间的法治化是网络治理的重要策略,宪法和法律是数据库的合法代理人。Digit is the medium of communication for network culture. The digit is displayed as databas- es which secretly produce many variants of subject in the cyberspace. Democratization, commercialization and politicization of the databases drive variants of subject in the databases from private space to public space, which brings the danger of the invasion of personal privacy. The public deny the opening of the privacy of network, so personal privacy is bound to be emphasized and studied in the era of big data. Legalization of cyberspace is an important strategy of network governance, with the Constitution and relevant laws being the legal representative of the databases.
