行贿犯罪与受贿犯罪处罚一致性研究——以商业贿赂犯罪为对象

摘　　要：我国目前对行贿犯罪的刑罚处罚过轻,并且缺乏处罚的一致性,特别是在商业贿赂犯罪中,多次行贿、行贿数额巨大以及项目投资、建筑系统等重要领域的行贿犯罪行为具有严重社会危害性,轻刑化不足以抑制行贿犯罪的滋生。因此,我国立法上有必要规定,在商业贿赂犯罪中,严重的行贿犯罪应该与受贿犯罪刑罚处罚一致,即特定情形,比如商业领域中,主动行贿、多次行贿等犯罪行为的社会危害性与受贿犯罪的社会危害性相当,甚至其危害性严重于受贿犯罪的情形下,行贿犯罪与受贿犯罪在法定刑的量刑档次上应该是相同的,然后根据各自的量刑情节在该量刑档次中进行刑罚处罚。At present, the punishment of bribery crime is not severe, and lack of consistency, especially in commercial bribery, the huge amount and happening in the important areas such as project investment,construction system have serious social harm, and the light punishment is not enough to curb the breeding of bribery. Therefore, the legislation of our country should have the necessary provisions, in the crime of commercial bribery, the punishment of serious crime of bribery should be consistent with the bribe-taking crime,that is, in special cases, especially those in active bribery, bribery of many times, bribery crime as harmful as the bribe-taking crime, even more harmful. So the bribery crime and bribe-taking crime in legal punishment sentence grade should be the same, then make its sentence according to the respective circumstances.
