摘　　要：精神病人强制医疗的启动程序是指法定启动主体对于符合法定启动条件的特殊适用对象(精神病人),根据法定启动方式向人民法院提出给予其强制医疗申请的基础性独立程序。就我国精神病人强制医疗的启动程序来说,仍然存在着适用对象的范围相对狭窄、启动条件中"有继续危害社会的可能"的规定不明确等不足。这些不足直接影响到精神病人强制医疗的启动,由此,完善我国精神病人强制医疗的启动程序成为亟待解决的问题。适度扩大适用对象的范围、扩大申请启动程序的主体范围等相关措施则显得尤为重要。The start procedure of compulsory medical treatment for the mental patients is a basic independent program that the statutory initiation subjects raise a compulsory medical application which is suitable for the special objects（the mental patients） conforming to the statutory conditions to the People ＇s Court,according to the legal ways. But this system in our country has so many deficiencies, including that the scope of the objects is narrow relatively, the content about ＂ the possibility of continued danger to society＂ in the start conditions is not clear and so on. These deficiencies will affect the start of the compulsory medical treatment for the mental patients directly, therefore, it＇s very urgent to improve the initiation of the mental patients＇ mandatory medical treatment in China. It＇s important to expand the scope of the objects reasonably, and extend the scope of the subjects who can start the program moderately, etc.
