摘　　要：技术标准化垄断归根结底是标准必要专利的许可问题,我国反垄断执法对其多是处以行政罚款,必要专利的许可价格最终仍由专利权人确定。经营者承诺制度作为反垄断执法中一项重要的和解制度,可以在反垄断调查初期,促使标准必要专利权人纠正其违法行为,减轻或消除垄断行为对竞争的影响,在自愿基础上对标准实施者授予合理的许可价格,并避免了漫长的调查及侵权诉讼带来的成本损失,是一种高效、低成本解决垄断纠纷的制度。因而,经营者承诺制度适用到技术标准化反垄断中具有充分的现实基础。在明确技术标准化垄断行为属于经营者承诺制度的适用范围基础上,从经营者承诺制度的提起主体、申请时间、经营者承诺后的公示制度和听证制度、审查标准、强化对承诺内容的监督以及违反承诺的法律责任等方面,对该制度适用于技术标准化反垄断的具体程序加以完善,将有力地推动技术标准的顺利实施。Monopoly of technology standardization is ultimately the question of licensing standard essential patents,imposing fine penalties is the common means in Chinese Anti-monopoly law enforcement,patent licensing fees still leave to patentee. As a important reconciliation system in Anti-monopoly enforcement,commitment system is an efficient and low-cost dispute resolving system,which will urge standard essential patentee correcting their illegal activities,relieving or eliminating the adverse effect on competition during the beginning of antitrust investigations,and conferring reasonable licensing fees to standard implementers on voluntary basis,length investigation and losses of infringement actions will be avoided. Therefore,the application of commitment system is full of realistic foundation. On the basis of determining monopoly behaviors of Technology standardization in the application scope of commitment system,this paper will perfect application procedures of commitment system from the subject,time of application,publicity system and hearing system,scrutiny standard,powerful supervision on commitment contents,responsibility of violation commitment,which will promote the smooth implementation of technical standards.
