再探易科罚金与罚金刑易科的适用

摘　　要：易科罚金制度与罚金刑易科制度能否纳入我国的刑罚体系之中?对于该问题的探讨近年以来较为激烈,总体而言反对的呼声较高、阻力较大。本文首先对易科罚金制度与罚金易科制度在国外的适用现状加以分析。其次,通过实证方法探究短期自由刑与罚金刑在我国的执行状况,剖析二者在适用上的弊端与优势。再次,提出短期自由刑与罚金刑在适用上的互补与同质关系,针对易科罚金制度与罚金易科制度引入我国的可能性提出一管之见。The subject of whether alternative imposition and criminal fine exchanging institution can be applied in our country＇s penalty system has been argued for a long time under the strong opposition and large resistance. In this paper,we first analyzed the foreign application situation of the alternative imposition and criminal fine exchanging institution. Then we studied the implementation of short-term penalty against freedom and fine penalty in our country empirically and analyzed the advantages and disadvantages of them.Next,the paper proposed the complementary and homogeneous relationship between short-term penalty against freedom and fine penalty and own opinions on the possibility of introducing alternative imposition and criminal fine exchanging institution into China.
