摘　　要：民办学校2014年所涉及的68个法律纠纷案例反映了目前民办学校的治理存在一定问题。民办学校主体性质的法律定位不清,法人财产权与出资人的合理回报制度在实施中存有障碍。民办学校内部决策机制失衡,师生管理存有瑕疵,资产和财务制度缺乏监管。在我国提出民办学校分类管理改革的基础上,应进步细化民办学校内外部治理的具体措施。68 cases of private schools in 2014 reflect the current problem of private schools in the external governance and internal governance. The legal position of the main character of private school is not clear,and the legal person property rights and the reasonable return system of the investors have obstacles in the implementation. The internal decision-making mechanism of private schools is unbalanced,and the management of teachers and students is flawed,and there is a lack of supervision on the financial system. We should put forward the specific measures of the internal and external governance of private schools.
