对邮轮合同法律性质的探究及思考

摘　　要：随着国际海上运输的发展完善和国际旅游业的快速发展,乘坐豪华邮轮到各个旅游胜地观光旅行受到了人们的青睐。豪华邮轮旅游在旅游业中已经成为了一个重要而且具有很高经济效益的旅游方式。但与此同时,在豪华邮轮旅游中一些潜在法律问题也随之产生,中国邮轮领域的法律尚为空白,邮轮旅游中的重要法律凭证——邮轮合同的性质目前仍无定论。笔者从邮轮基本概念切入,分析邮轮合同与邮轮客票的关系以及邮轮合同的法律性质,在比较邮轮合同与海上旅客运输合同以及旅游合同在特征上的相同点和不同点基础上,提出邮轮合同属于混合合同的结论。With the rapid development of international tourism industry and international transportation at sea,more and more tourists choose the luxury cruise ship for funs. Cruising tour has become one of important tourism methods which have very much higher economic benefits. However,some potential legal problems come out accordingly. The legal nature of cruise contract—which is very important evidence for cruise tour,is still undefined in China now. The paper tries to analyze the relationship between cruise ticket booklet and cruise contract as well as the legal nature of cruise contract on the basis of some concepts concerned with cruise ship,further it points out the differences between cruise contract,contract of carriage of passengers at sea and tour contract,and comes to the conclusion that cruise contract is one of mixed contract which combines the contract of carriage of goods by sea with tour contract.
