摘　　要：法律作为一种文化现象,对其研究应置于文化的视域之中。文化的核心是价值,对法律文化、私法文化的研究重点是其与现代文化价值相一致的价值取向。没有现代私法文化价值作为指导,难以建立理想的现代私法制度。我国目前私法学界存在着对于私法文化问题重视不够、研究不足的问题。应将私法放置在整个现代文化、现代法律文化、现代私法文化的背景之下,探寻与现代文化价值取向相一致的现代法律文化以及现代私法文化的价值诉求,为我国私法制度的构建,尤其是民法典的编纂确立价值基准。As a kind of culture phenomenon,law＇s reseach must be placed into the culture vision field. The core of culture is value,the key point of law culture and private law culture reseach is the coincident value orientation between law culture,private law culture and modern culture value. Without the directive from the modern private law culture value,ideal modern private law system should not be established. There exists issues unsolved,such as private law academia did not pay attention to private law culture and reseach private law culture nsufficient. We should place private law in the context of the whole modern culture,modern law culture and modern private law culture,seek the value appealing modern law culture and modern private law culture in accordance with modern culture,establish value criterion for the construction of private law system almostly the compilation of Civil Law Code.
