摘　　要：当下,我国农民专业合作组织集特殊企业与第三部门两种组织属性及经济社会功能于一身,在多元发展的过程中必须逐步实现一体化。全面体现合作社的复杂组织属性,是合作社法律制度创新的关键与难点。修改《农民合作社法》,应当基于合作社双重属性的法理依据与实践需求,围绕合作社两种属性的有机结合,即融新型农业经营与服务主体功能于一身,确定合作社法律制度创新的目标,完善配套的组织与运行制度。At present,professional cooperative agency of farmers combines two kinds of organization property,special business and third sector,with socio-economic functions,and at the same time,it realizes integration with diversified development. The key and difficult part to realize legal system innovation is to fully reflect the complex properties of professional cooperative agency of farmers. Based on the discussion of theoretical and practical practice,the modification the ＂Law of Professional Cooperative Agency of Farmers＂should be built on the combination of two kinds of properties,that is,the combination of new agricultural management and service functions,set up goals of legal system innovation,and improve the relative organization and operation system of professional cooperative agency of farmers.
