摘　　要：种族灭绝罪规范的研究有赖对案例的分析和总结,而纳粹对犹太人的灭绝行为是灭绝罪的历史起源,且相较之后的案件具有典型性、严密的组织性和危害后果的严重性——对纳粹案进行规范分析,借此探讨灭绝罪的行为方式、结构,解决适用中的难题,得出了应在本罪行为方式规定中排除迫害性行为及将灭绝罪界定为集体犯罪的结论,有利于规范的进一步完善。In consideration of Nazi＇s genocide acts serving as the fact origin of genocide crime and featuring representativeness and severe perniciousness comparing with those following, combining the stipulations of 1948 ＂Convention on the Prevention and Punishment of the Crime of Genocide＂ to the key components of genocide crime, there explores the genocide facts conducted by Nazi, analyzes some questions about the crime of genocide at the objective aspect, and further clears and defines the key components of genocide crime, so as to clarify some questionable points.
