合适成年人参与制度的形式化——社会工作者的参与观察和反思

摘　　要："合适成年人"参与未成年人刑事诉讼程序是对未成年人一种特殊保护的国家刑事司法制度,这一制度在走向完善的同时,也开始出现了形式化倾向。通过参与观察和访谈,发现办案人员的高工作负荷、重刑报复的传统刑罚观念、对未成年人知情同意权的轻视、机构之间的利益关联以及办案人员和未成年人的"合谋"等因素共同造成了制度的形式化。While advancing towards formalization, the institution of appropriate adults' participation also undergoes superficialization or insubstantialization. Based on participant observation and interviews, this article examines the manifestations and pushing forces of the process of superficialization. It is found that the heavy workload of the police, the traditional attitude toward crimes which upholds punishment, the neglect of children's right to informed consent, the interest connection between the police and the social work organization, and the‘conspiracy'between the police and the involved child all contribute to the superficialization of the institution. Suggestions are also made to counter the trend.
