摘　　要：中国传统的大方讼观是一把双刃剑,既有其积极的一面又不乏消极的部分。现代社会追求法治建设,对厌讼观的形成、原因等方面进行深刻探究,并结合当下的国情,取其精华,去其糟粕,必将促使法治社会的进一步实现。Chinese traditional lawsuits view is a double--edged sword, has both the positive and negative parts. Concept of the pursuit of the rule of law construction in modern society. Deeply explorating the cause and formation of concept of hate litigation, combined with the current national conditions, discard the dross and select the essence. This method will encourage further implementation of the society ruled by law.
