摘  要:当代中国劳工的集体行动没有突破"依法抗争"框架。在这一框架内,由于集体维权的制度供给不足,结构性关联较弱的工人的自发行动又受限于法律,抗争动员呈现弱组织化状态。弱组织动员的主要特征包括:维权精英合法性不稳定、利益整合随意性、精英决策分歧和组织约束力有限。初衷是合法维权的集体行动会因此走向无序和激进,产生"依法抗争悖论"。只有保障工人集体权利并建立制度化协商方式才能有效化解劳资冲突。The labor's collective action in contemporary China has not broken through the framework of "rightful resistance". In this framework, due to the lack of institutional supply of collective rights, the spontaneous action of workers with weak structural association is limited by the policies and laws, contentious mobilization show weak organized state. Weak organization's main features include: the unstable of elites legitimacy, the randomness of interests integration, the divergence of elites' decision- making and restricted of binding force. Therefore, collective action of legitimate intention will become disorder and radical, appear the "paradox of rightful resistance. " Only protect workers' collective rights and establishment consultation institution can resolve conflicts effectiwlv
