摘　　要：从数字图书馆合理使用制度构建的现实需要和基本原则来看,我国现有的法律规定存在在数字图书馆合理使用方面缩减失当、对数字图书馆合理使用制度范围的规定过窄、缺少对网络作品使用行为规范的调适等问题。为此,须从拓宽图书合理使用权限、推行数字图书法定许可制度、创新作品使用方式和范围等方面着手,不断完善我国数字图书馆的合理使用制度。View from the realistic demand and basic principle of digital library＇s rational use institution, the law stipulation about digital library＇s rational use rights in our country currently cut and reduced inappropriately, the stipulation of digital library ＇s rational use rights is too narrow, lack of adjustment for network work using, etc.For this, we should expand digital library ＇s rational use rights, practise digital library＇s legal permission system, creative the way and scope of using digital books and so on to perfect the digital library＇s rational use institution continuously.
