国际法庭在《海洋法公约》争端解决程序中的剩余强制管辖权——兼论对解决我国南海问题的启示

摘  要:临时措施、迅速释放与初步程序虽然均规定于《联合国海洋法公约》第十五部分"争端的解决"中"导致有拘束力裁判的强制程序"一节,但国际法庭在行使这三项权利前必须确立其具有与在一般强制程序中不同的管辖权。其中临时措施需具有"非预判性"的初步管辖权、迅速释放需具有"独立自给"的特别管辖权,而初步程序则需具有"专设"的预审式管辖权。且国际法庭在该节中所具有的剩余管辖权与我国的南海问题密切相关,应予以重视。Although provisional measures, prompt release and preliminary proceedings are stipulated in "compulsory procedures entailing binding decisions" from the fifteenth part "settlement of disputes" in UNCLOS, the international tribunal, before exercising these three rights, must confirm that they have the jurisdiction which is different from that in the general compulsory procedures. Provisional measures should be provided with a "non- prejudge" primary jurisdiction, prompt release should be provided with a special "self-sufficient" jurisdiction, and preliminary proceedings should be provided with a "special-established" prejudged jurisdiction. Particularly a dose relationship exists between the remaining compulsory jurisdiction that the international tribunal is entitled in this section and South China Sea disputes, which is worth due attention.
