摘 要:食物权已被国内外学界广泛认可,但食物权的国家给付义务却鲜有学者论及,而它却是食物权得以保障和实现的关键所在。故对于食物权的国家给付义务这一领域的系统化研究就尤为必要,其对充实与完善食物权的研究空白具有重大理论和实践价值。食物权国家给付义务的确立与基准对于食物权的实现十分重要。前者的内在逻辑涵摄食物权的国家给付义务的历时流变、理论证成、法律理据及其具体内涵,这些内容不仅可以论证食物权国家给付义务的正当性,而且可以明确它的具象性。后者以基本生存、相对平等以及国家能力三个维度为基准对给付程度进行规范,它是食物权国家给付义务履行的关键。The right to food has been widely recognized by chinese and foreign scholars. However, the state provision obligations of the right to food have rarely been addressed, which is the key to ensure and realize the right to food. It is necessary to systematically research the state provision obligations of the right to food, and the research is of great theoretical and practical value for filling the academic vacancy. The establishment and criteria of the state provision obligations of the right to food is very important for the realization of the right to food. The former mainly includes its diachronic changes, theoretical justification, legal basis, and specific connotation, which can not only demonstrate the legitimacy of the state provision obligation of the right to food, but can clearify its representations; while the latter standardizes the provision level in three dimensions: basic survival,relative equality, and state capacity, and it is the key to the state provision obligation of the right to food.
