摘　　要：在文献研究基础上,分析了中医传承与创新的逻辑过程和知识产权制度对传承与创新过程中不同环节的激励作用,从而提出了建立符合中医特征的知识产权制度的建议:一是加大中医药传统知识保护;二是根据中医隐性知识和垂直思维特点建立专门知识产权保护制度。Inheritance and innovation is the inevitable requirement of the development of Traditional Chinese Medicine （TCM） and needs the intellectual property （IP） system to escort. Based on the literature research, this paper analyzes the TCM inheritance and innovation logic process and IP right incentive effects on different links in the process of inheritance and innovation, thus put forwards some suggestions. The one is to increase the protection level of traditional knowledge of TCM; the other is to establish special IP protection system based on TCM features of full of tacit knowledge and vertical thinking.
