论集体林地承包权与经营权的分离与流转

摘　　要：集体林地使用权流转可分为承包经营权整体流转和集体林地经营权分离流转两大类。农林产业规模化发展需要集体林地大量流转和集中。集体林地承包权与经营权的分离,可以推动集体林地使用权的流转。进一步推行林地经营权分离流转形式,而非承包经营权整体流转,仍存在诸多阻碍集体林地经营权流转的因素,应从完善林业产权制度、完善集体林权流转制度、集体林地相关制度的配合,以及地方政府加强宣传和引导等方面提出对策。The variety of rights transferred in collective forestland can be divided into the whole contracted management, and the management right only. It needs extensive circulation and centralization of collective forestland to make agriculture and forestry more large-scale. Separating the management right from contracted management, will promote the circulation of collective forestland usufruct in China. Transferring the management right, without the contract right, should be further promoted in our country. In reality, however, this way is still hindered by many factors, which could be solved from following aspects, that is perfecting the forestry property rights system, perfecting the collective forest rights circulation system, cooperating with relevant systems, and strengthening the propaganda and guidance by local government.
