上海自贸区负面清单管理模式探析

摘　　要：以负面清单管理为主要特征的投资协定已经逐渐成为国际贸易谈判和规则制定的新趋势,世界上至少有77个国家采取了这种模式。上海自贸区的负面清单管理模式,是在世界贸易格局迅速重构背景下与国际接轨的必要之举。目前,负面清单已经推出了3版,内容更趋简化,限制重点也更加清晰,后续还将推出更新版本。负面清单拟定阶段如何权衡、实施效果如何评价,有必要探讨相应的科学分析评价及风险控制等方面的方法,为今后的版本更新提供科学依据。Investment agreements with the main characteristics of negative list management have gradually become the new trend of international trade negotiations and regulations, at least 77 countries in the world have adopted this mode. Under the rapid restructuring of the world trade pattern, Shanghai Pilot Free Trade Zone also adopts the negative list management mode in order to conform to international convention. At present, the negative list has been updated 3 edi- tions, and the content is more simplified, the focus is more clear. Moreover, the follow-up will also be launched to update the version. This paper analyzes the changes of the negative list of Shanghai Pilot Free Trade Zone, discusses the methods of its decision analysis and the performance evaluation. Furthermore, it also studies how to control the risks during the decision making and the implementation process in order to provide scientific basis for future version updates.
