摘　　要：中国网民通过网络媒体获取资讯的现象已经达到了空前的繁荣程度,导致网络转载纠纷案件猛增。对网络转载侵权行为的规制成为重要的法律课题。本文从分析和评述网络转载立法入手,结合实践中的诸多问题进行理论反思,最后提出完善立法的几点思考,建议立法中应增加网络转载法定许可制度,并对网络转载侵权行为的规制提出了看法,为规范我国网络转载的混乱现象提供借鉴。The phenomenon of Chinese Internet users obtaining information through the Internet has reached an unprecedented degree of prosperity,which led to the network reprint dispute cases soared.The regulation of Internet reprinting infringement is an important legal issue.Started with the analysis and comment on the network reprint legislation,hereafter with the oretical reflection on many problems in practice;finally put forward some suggestions to improve the legislation,namely,the proposed legislation should increase the legal permission system for network reprint,and put forward the opinions on the regulation of the Internet reprinting infringement.Provide reference in order to regulate the chaos phenomenon of the network reprint.
