对交通违法买分卖分行为的思考

摘　　要：目前,交通违法数量仍有增加趋势,"买分卖分"现象严重。首先,阐述了交通违法后续处理过程的繁琐性和弊端;其次,从交通法律法规及相关制度不够健全、驾驶人自身法律意识淡薄、交通违法行为信息采集模式有待完善、执法人员自身素质有待提高等方面,分析了导致"买分卖分"现象产生的主要原因;最后,参照国内外对类似问题的解决办法,从完善交通违法监控系统、完善交通违法处罚模式、加强交管队伍建设与管理等方面,就减少"买分卖分"现象提出了具有可行性的建议。Nowadays, with an increasing number of traffic violation, the phenomenon of ＂buying and selling license points＂ still remains serious. This article will, first of all, elaborate the complexity and malpractice in the post-treatment process of traffic violation; then, analyze primary causes of the phenomenon of ＂buying and selling license points＂, by listing several aspects including the unsound traffic laws and regulations and the relevant systems, the weak legal consciousness of drivers, the incomplete information-collecting mode of traffic violation behavior, and the inner quality of the law enforcement officials that needs to be improved and so on; finally, with the reference to the solutions of similar problems from home and abroad, put forward some practical advice to the phenomenon of ＂buying and selling license points＂, such as improving the monitoring system and punishment mode of traffic violation, strengthen the construction and management of the traffic control team, etc.
