“云南少数民族传统医药保护条例”立法构想

摘　　要：新形势下,新《云南省发展中医药条例》已经表现出诸多局限性,为此建议制订"云南少数民族传统医药保护条例"(简称"条例")。"条例"旨在应对云南少数民族传统医药面临的现实困境,促进资源优势向产业优势转化。现有学术成果、全国性立法成果及地方保护经验共同为"条例"立法提供了丰富的理论、技术资源。"条例"以促进云南少数民族传统医药知识的认同、重视、发掘、保存、传承与开发为立法目的,拟采用兼具非物质文化遗产保护制度、知识产权制度特色的混合保护模式,并针对云南少数民族传统医药面临的主要问题,建立相应的具体保护制度。There are limitations of Regulations for Development of Traditional Medicine in Yunnan in new era,which causes to make Regulations for Protecting Traditional Medicine of Ethnic Groups in Yunnan.The Regulations are to face the dilemma of Traditional Medicine of ethnic groups in Yunnan and innovate the policy. Current research achievements,Protection Law of Traditional Chinese Medicine,the experience of carrying out Regulations of Yunnan Province on the Development of Traditional Chinese Medicine and many other protecti on regulations provide rich theoretical and technical resources for making the regulations. Facing the challenges of the Traditional Medicine of ethnic groups in Yunnan,the corresponding regulations cover the survey,regulation,broadcasting policy,registering policy,policy for biological and cultural resources protection,inheriting policy,policy for standardization,policy for acquiring,knowing and sharing the resources,policy for industrialization and the policy of governmental support and management.
