北京市昌平区55起非法行医涉嫌刑事犯罪移送公安机关案件分析

摘　　要：目的明确北京市昌平区目前非法行医涉嫌刑事犯罪案件移送公安机关（以下简称“移送”）的形势，为进一步做好打击非法行医工作及为非法行医涉嫌犯罪行刑衔接工作提出建议。方法选取2010年1月1日～2014年12月31日期间，北京市昌平区55起非法行医涉嫌刑事犯罪移送案件资料进行统计分析。结果2010～2014年，移送案件的数量呈先增加后下降趋势，在2011年达到最高值；55起移送案件的当事人中，61．82％的年龄为35～50周岁，72．73％的当事人为男性，60％的当事人未取得任何行医资质，52．73％的当事人非法行医时间在3个月以内；移送原因均为“被卫生行政部门二次处罚后，再次非法行医”。结论打击非法行医工作是一项长期、艰巨和复杂的工作，而非法行医案件的移送涉及多个部门，需要创新执法手段、增强执法有效性，进一步完善法律法规体系，加强各执法部门配合、建立长效监管机制。Objective This study aimed to explore the current situation of case transfer in relation to illegal medical practice in suspicion of crimes, in order to provide suggestions to crack down on illegal medical practice and link illegal medical practice in suspicion of crimes with Criminal Prosecution. Methods 55 transferred cases in relation to Illegal medi- cal practide in suspicion of crimes in Chang Ping District of Beijing were collected from 1~＇ January, 2010 to 31＂t December, 2014 for statistic analysis.Result The number of case transfer between 2010 and 2014 increased in the early stage and dropped later. It reached to the highest value in 2011. The case transfer occurred in Bei Qi Jia, Hui Long Guang, Dong Xiao Kou and Sha He areas of Chang Ping District. Among the 55 cases, 61.82% were aged between 35~50; 72.73% were male; 60% do not have any qualification for medical practice; 52.73% undertook illegal medical practice within the period of 3 months; for all 55 cases, the cause of transfer was ＂undertaking illegal medical practice after being punished by health ad- ministrative department twice＂.Conclusion it is an arduous long-term task to crack down on illegal medical practice. The case transfer of illegal medical practice requires collaboration between multiple departments. It needs more publicity, sound distribution of medical resources, solution to medical treatment for immigrants, innovation on enforcement means, strengthening the effectiveness of enforcement, further improving legal system, facilitating the cooperation between law en- forcement departments and establishing long-term supervision system.
