摘  要:以上海市为案例研究地区,对目前村庄规划的编制与实施情况进行分析,总结农村土地产权特征与权属格局对村庄规划实施的影响。目前农村集体土地使用权高度分散,规划实施必然涉及权属的调整问题。而土地所有权分属不同主体、土地所有权主体虚置、土地产权变更与登记制度不完善等因素制约着规划实施过程中的土地权属调整。当前实践中,相关主体通过多种方式进行土地权属的调整以促进规划的实施,但受到实施条件的限制,其开展范围有限。从土地权属调整的角度来看,在规划编制时充分考虑土地产权因素、减少土地权属调整的难度和矛盾是促进村庄规划实施的重要途径。The paper takes suburb of Shanghai as a case study area, analyzes the current situation of village planning and implementation, and summarizes the influence of characteristics and attribution of land property rights on the implementation of village planning. At present, the land-use rights of rural land is highly dispersed, so the planning implementation will inevitably involve the adjustment of the land attribution. And as the land ownerships belonging to different subjects, the subject of land ownership of rural collective land is vacant, the system of collective land property right change and the registration is not perfect, these factors restrict the adjustment of land attribution in the process of planning implementation. In current practice, the relevant subjects adjust the land attribution through variety ways in order to promote the implementation of village planning. But it is restricted by the relevant conditions; its application range is limited. From the perspective of adjustment of land attribution, it is a viable way to implement village planning to take full account of the land attribution and reduce the difficulty and contradiction of land attribution adjustment.
