摘 要:网络言论自由是公民享有的一项基本权利,但网络之于公民言论自由不限于媒介作用,还会实质影响该项基本权利与其他权益之间的关系。代表公权力的政府能在多大程度对网络言论进行限制与保护,其核心在于如何协调言论自由与其他权益间的价值冲突。因而,探寻网络言论自由的界限需要进行价值判断与价值选择。当前我国网络言论监管体系在灵活性与适应性方面仍无法完全因应网络发展的需求,需要借鉴国外的监管经验,立足于本国特点建立相对公平的权益衡量机制、统一立法标准、充分运用"法律"与"网络技术"等综合监管手段,以平衡言论自由与其他权益之间的互动关系。Free speech on the internet is a basic right for citizens,but the internet is not only the expression vector for citizens,but also the substantial factor of influencing the relationships with the basic rights and interests. Whether and how governments,on behalf of power,can regulate free speech on the internet lies on the coordination with rights,value and interests. Hence,the process of exploring boundaries of free speech on the internet goes with a process of value judgments and value choices. The existing regulation system in China is not enough to fully meet the needs of the development of internet in the aspect of flexibility and adaptability, and needs to draw lessons from foreign experiences.Based on the native features of rule of law in China,it needs to establish a special internet legal system with clear effect structures,and also a relatively fair judgment mechanism of rights and interests fully using the legal means,internet technology means as well as other comprehensive regulation methods in order to balance the relationships between rights and other interests.
