中国体育彩票法律规制结构的制度改进

摘　　要：我国近年来体彩乱象治理乏力,根源在于我国体育彩票法律规制结构存在缺陷。根据《彩票管理条例》的规定,体彩由财政部负责监管,体育总局下设"体彩管理中心"负责体彩的具体经营,但财政部监管权有限,真正意义上的体彩发行、销售、开奖、兑奖过程的监管则由"体彩管理中心"进行自我规制。这种特殊的法律规制结构造成了如下三个方面的缺陷:政企不分、架空消费者利益的规制主体结构;国家专营、二元分立的非正当性经营结构;权力虚化、信息偏在的监管运作结构。应当对体育彩票法律规制结构中的监管者和经营者进行主体建制的改造,形成以财政部下属的彩票监管局为统一监管主体、以中国彩票总公司为统一经营主体的良性结构,同时实现政企分开、经营正当性和刚性监管权。In the recent years,the inefficiency of sports lottery governance in China come from the defects in China＇s sports lottery legal regulation structure.According to the＂Lottery Regulations＂,the Ministry of Finance is responsible for supervising the issuing of the lotteries,and Sports General Administration designates the Sports Lottery Management Center to be in charge of sales of the lotteries.However,due to the limited the treasury custody of the Ministry of Finance,the issuing,the sales,the announcement and the cashing of the lotteries are done by the Sports Lottery Management Center.Therefore,problems have emerged.Firstly,the government administration is not separated from the enterprise administration,doing harms to the consumer＇s interests.Secondly,the nation controls the operation,leading to the legitimacy of non-binary separation management structure.Thirdly,the supervising structure does not work.To solve the problems,the lottery sports legal regulation structure should transform the responsibilities of the regulators.Under the Ministry of Finance,a unified regulatory body should be formed to supervise the lotteries.The Chinese Lottery Corporation takes responsibility for the unified management.Meanwhile,the governance body should be separated from the enterprises,the operation should be honest and the regulations should be rigid.
