摘 要:环境政策与环境法律是中国环境保护最为重要的两种制度工具,二者相互交织、共生共济,型构了中国环境法治的实践图景;环境法律政策化和环境政策法律化是环境政策与环境法律之间联接、互动的主要途径和方式;环境法律政策化应以环境政策与环境法律的功能"区分"为前提,实现环境政策对环境法律灵活性机能的补给与拓展;环境政策法律化则是以法律的稳定性持续彰显现代环境法治理念与价值的重要方式;囿于环境政策与环境法律在环境保护中的工具性局限,中国环境法治的未来发展应当走向以制序为基础的环境保护新格局。Environmental policy and environmental law are the most important tools for China' s environ- mental protection; they are intertwined and inter-dependent in terms of survival and thriving, forming the realistic scenario of China' s environmental law in practice. The systemization of environmental law and the legalization of environmental policy are the main tools to achieve connection and communication between environmental policy and environmental law; the prerequisite for the systemization of environmental law lies in the different functions that environmental policy and environmental law have, and the environmental policy should "distinguish" itself by supplementing the environmental law and expanding the function of flexibility. The legalization of environmental policy is to achieve the stability of the law so that the concept and value of modern environmental law can be continuously fulfilled. Constrained by the instrumental nature of the environmental policy and environmental law in environmental protection, the development of China' s environmental law should prioritize social orders.
